Engagement Ring Given Before Marriage

If you did things the traditional way and your ex got down on one knee and gave you the beautiful engagement ring you are now interested in keeping (even though you will be divorced soon) the answer is yes you will be able to keep your ring because it is yours. Your husband gave it to you—it belongs to you. If however, you did not receive a formal engagement ring from your ex before you got married and purchased it later after the marriage was authenticated, that’s a whole other story. The wedding band was given to you at the moment of marriage, but technically right before your union was announced; it should therefore be considered, once again, a gift given to you by your ex, pre marriage.

Engagement Ring Given After the Marriage

Some couples can’t afford a nice engagement ring before they are married and opt to purchase one later on in the marriage. Unfortunately this is now community property due to the fact that you purchased it while married. You might still be able to keep the ring but it gets a little touchier when the ring is purchased post marriage. If your marriage is common law, and has not been authenticated or documented in an official manner, all bets are off. Any rings, gifts or otherwise will have to be fought over in court or in the judge’s chambers with a lawyer.

All bets are off as well, if there was a prenuptial agreement stating that the ring would be the property of a certain person should divorce become a factor.
